1. Agreement to Terms

By accessing or using QRsona services, including our website (qrsona.com), online store, QR code platform (app.qrsona.com), and purchasing our products, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms apply to all visitors, users, customers, and others who access or use our services.

2. Our Services

QRsona provides:

• E-commerce Store — sale of physical QR code products (t-shirts, hoodies, polo shirts, stickers, cards, keychains, and more).
• QR Code Platform — digital platform for creating, managing, and tracking QR codes.
• vCard Business Cards — creating and sharing digital business cards.
• Forms — creating contact forms linked to QR codes.
• Split Links — splitting traffic from one QR code to multiple destinations.
• Schedules — automatic target link changes based on time schedules.
• Analytics — scan statistics (country, city, time) with a dashboard.
• Push Notifications — real-time notifications about QR code scans.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services. By using our services, you represent and warrant that you meet this age requirement.

4. Account Registration

To use certain features of our platform, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

One account is assigned to one person or company. Sharing login credentials is prohibited.

We reserve the right to suspend or terminate your account if you violate these Terms, we suspect fraudulent or illegal activity, or as required by law.

You may terminate your account at any time by contacting us at info@qrsona.com.

5. Acceptable Use Policy

5.1 Prohibited Content

You agree NOT to use our QR codes or services to link to, promote, or distribute:

• Illegal Content — any content that violates local, national, or international law.
• Adult/Pornographic Content — sexually explicit material.
• Violent Content — content promoting violence, terrorism, or harm to others.
• Hate Speech — content promoting hatred or discrimination.
• Fraudulent Content — scams, phishing, identity theft.
• Malware — viruses, malware, spyware, or other malicious software.
• Intellectual Property Violations — content infringing copyrights or trademarks.
• Child Exploitation — any content involving minors in harmful contexts.
• Drugs/Controlled Substances — illegal drugs or controlled substances.
• Weapons — illegal weapons or explosives.
• Spam — unsolicited bulk messages or misleading redirects.
• Doxxing/Privacy Violations — sharing private information without consent.
• Impersonation — impersonating others or misrepresenting identity.

5.2 Your Responsibility

YOU ARE SOLELY RESPONSIBLE for all content you link to through your QR codes, for ensuring your QR code destinations comply with these Terms, and for any consequences resulting from the content you link to.

5.3 Monitoring and Enforcement

We reserve the right to monitor QR code usage, investigate reports of abuse, remove or disable QR codes that violate these Terms, suspend accounts of violators, and report illegal activity to law enforcement.

5.4 Reporting Abuse

If you discover a QR code linking to prohibited content, please report it immediately to: info@qrsona.com. Include the QR code URL or identifying information in your report.

6. Disclaimer of Liability for User Content

IMPORTANT: QRsona is a platform provider. We do NOT control what content users link to through QR codes, do NOT endorse any content, products, or services linked through QR codes, do NOT verify the accuracy, legality, or appropriateness of user-linked content, and do NOT accept responsibility for user-generated content.

YOU USE QR CODES CREATED BY OTHERS AT YOUR OWN RISK.

We are not liable for any damages resulting from content linked through QR codes created by users, third-party websites accessed through QR codes, user violations of these Terms, or fraudulent or malicious use of QR codes by third parties.

7. Products and Orders

7.1 Product Information

We strive to provide accurate product descriptions, images, and pricing. Product colors may vary due to screen settings. We reserve the right to correct errors in product information or pricing. Product availability may change without notice.

7.2 Personalized Products

IMPORTANT: Products with QR codes are made to order per your specifications and:

• Cannot be returned or refunded except in cases of manufacturing defects or errors on our part.
• Are your responsibility to ensure accuracy of design, text, and other custom elements.
• Should be reviewed carefully before finalizing your order.

7.3 Pricing and Payment

All store prices are listed in the currency displayed on the website. Prices do not include local taxes, customs duties, or import fees (see Section 7.5). Store purchases are processed through Shopify's native checkout. Subscription payments for platform plans are processed by Stripe.

7.4 Order Fulfillment

Physical products are printed and shipped by our fulfillment partner Printful. Fulfillment time depends on the product and delivery location.

We reserve the right to refuse or cancel any order due to product unavailability, pricing errors, suspected fraud, or violations of these Terms.

7.5 International Orders

For international customers: you are responsible for all customs duties, import taxes, and local fees. Delivery times may vary based on customs processing. We are not responsible for customs delays or additional fees.

8. Plans and Payments

QRsona offers three plans: Starter (free), Pro, and Business. Pricing details are available on the homepage in the Plans section.

Payments for paid plans are processed by Stripe and charged monthly or annually in advance. We do NOT store full payment card details — these are processed exclusively by Stripe (PCI-DSS certified).

14-day free trial: New users can activate a free 14-day trial of a paid plan without providing card details. The trial is one-time per account.

Plan limits: Each plan has specific limits for scan analytics, forms, split links, schedules, saved links, and vCard templates. QR codes always work regardless of plan — limits apply only to analytics and advanced features.

Subscription cancellation is possible at any time. After cancellation, access to paid plan features remains active until the end of the paid billing period.

Plan changes: Upgrade from Pro to Business is immediate with prorated billing. Downgrade from Business to Pro takes effect at the end of the current billing period.

9. QR Codes and Platform Features

Dynamic QR codes can be updated at any time through the Dashboard at app.qrsona.com. We strive for maximum service availability. We are not responsible for interruptions due to force majeure or planned maintenance.

QR code scanning depends on device capabilities and internet connectivity. Technical issues may occasionally affect service availability.

We expect reasonable and fair use of the platform. Examples of abuse include: automated scripts changing URLs hundreds of times per day, using QR codes for rotating spam, excessive API calls impacting service performance for other users, and commercial reselling of QR redirect services to third parties.

If we detect abuse, we reserve the right to temporarily throttle your account, contact you to resolve the issue, or suspend your account.

10. Intellectual Property Rights

10.1 Our Rights

All content on our website and platform, including the QRsona name, logos and trademarks, website design, software and platform technology, and product descriptions — are owned by or licensed to QRsona and protected by copyright, trademark, and other intellectual property laws.

10.2 Your Rights

You retain ownership of content you create using our platform, including designs, QR code configurations, vCard business cards, forms, and account data.

10.3 License to Use Our Platform

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platform for personal or business purposes, create and manage QR codes, and use purchased products for their intended purpose.

You may NOT: copy, modify, or distribute our software, reverse engineer or attempt to extract source code, remove copyright or trademark notices, or use our trademarks without written permission.

10.4 User Content License

By uploading content to our platform (designs, images, logos), you grant us a limited license to process and display your content as necessary to provide our services, print your designs on physical products you order, and store your content securely on our servers. We will not use your content for any other purpose without your permission.

11. Warranty Disclaimer

OUR PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that: our services will meet your requirements, QR codes will function indefinitely (though we strive for reliability), physical products will be defect-free (though we will address defects per our Refund Policy), or that third-party services linked through QR codes will be available or accurate.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, lost profits, revenue, data, or business opportunities, damages resulting from user-generated or third-party content, unauthorized access to your account, or viruses on third-party websites.

OUR TOTAL LIABILITY to you for any claim arising from these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim, OR €100 (whichever is greater).

Some jurisdictions do not allow limitations on implied warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless QRsona, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your violation of these Terms, your violation of any law or rights of third parties, content you link to through QR codes, your use of our services, or your breach of intellectual property rights.

14. Dispute Resolution

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts located in Ełk, Poland for resolution of any disputes.

Before filing a claim, you agree to contact us at info@qrsona.com to attempt informal resolution.

15. Termination

15.1 By You

You may stop using our services at any time by deleting your account, discontinuing use of our platform, or contacting us.

15.2 By Us

We may suspend or terminate your access immediately, without notice, for: violation of these Terms, illegal or fraudulent activity, abuse of our platform or services, non-payment, or any other justified reason.

15.3 Effect of Termination

Upon termination: your right to use our services immediately ceases, we may delete your account and data (subject to legal retention requirements), outstanding payment obligations remain due, and provisions regarding liability limitations, indemnification, and others that by their nature should survive termination — remain in effect.

16. Changes to Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date and provide notice of significant changes via email or website notice at least 14 days before they take effect.

Your continued use after changes constitutes acceptance. If you do not agree to changes, you must stop using our services.

17. General Provisions

Severability: If any provision of these Terms is found unenforceable or invalid, it shall be limited or eliminated to the minimum extent necessary, and remaining provisions remain in full force.

Entire Agreement: These Terms, together with our Privacy Policy and other policies referenced herein, constitute the entire agreement between you and QRsona.

No Waiver: Our failure to enforce any provision shall not be deemed a waiver of that provision.

Assignment: You may not assign or transfer these Terms without our written consent. We may assign these Terms to any affiliate or successor.

Force Majeure: We shall not be liable for delays due to circumstances beyond our reasonable control, including natural disasters, war, government actions, internet or telecommunications failures, and pandemics.
